Terms of Use and Privacy Policy

Photography contest known as "Sime Darby Capture 8 Photo Contest" ("Campaign") is organized and administrated by Sime Darby Property Berhad (“Company”) and is also the administrator for the Campaign. By participating in this Campaign, the Participant doing so shall be taken to have fully and unconditionally agreed to be bound by the Terms and Conditions stated below.

A. Eligibility of the Participant

  1. The Campaign is open to all individuals who have registered via Company Photography Contest Microsite (“Microsite”), who reside in Malaysia and aged 18 years old and above (“Participant”). The Participant must have a valid National Registration Identification Card (“NRIC”) number (12-digit) OR passport holder with valid number at the time of participation of the Campaign.
  2. The Participant is not an employee of the Company (“Employee”). However, Employee’s immediate family members (ie parents, spouse, children and siblings) are allowed to participate.
  3. Company reserves the absolute right to vary or amend the above the Participant’s eligibility criteria for the Campaign as it deems necessary from time to time.

B. Timeline

  1. The Campaign will commence from 8 April 2022 at 12:00 AM and ends on 7th December 2022 at 11:59 PM ("Campaign Period") or based on the time period shown on the Microsite, the later shall prevail;. The Company reserves the right to vary or amend the duration of the Campaign Period if it deems necessary. All entries or submissions received by the Company prior to or subsequent to the Campaign Period will not be entertained and is deemed to be invalid.

  2. The photograph(s) must be captured from the following Company’s development areas as per the timeline below:

C. Submission of Entries

  • The Participant is required to visit Microsite (https://www.simedarbyproperty.com/capture8photocontest) and register as member to submit his/her entry as of corresponding wave of the Campaign Period (“Entry”).

  • Entries are only accepted through online only.

    Professional Categories

    • The Participant is required to register at the Microsite (https://www.simedarbyproperty.com/capture8photocontest) to participate and submit in this Campaign.

    • The format and size of the submitted Entry must be in. PNG or JPG format with a minimum file size of 3MB (not exceeding 4MB).

    • The Participant required to publish his/her camera model, ISO, aperture, and shutter speed at the bottom of the photograph before submitting to the Microsite.

    Smartphone Categories

    • The Participant is required to register at the Microsite (https://www.simedarbyproperty.com/capture8photocontest) to participate and submit in this Campaign.

    • The format and size of the submitted Entry must be in. PNG or JPG format with a minimum file size of 3MB (not exceeding 5MB).

    Drone Categories

    • The Participant is required to register at the Microsite (https://www.simedarbyproperty.com/capture8photocontest) to participate and submit in this Campaign.

    • 360° degree photograph and panoramic view photograph are acceptable to participate in this drone category.

    • The format and size of the submitted Entry must be in PNG or JPG format with a minimum file size of 3MB (not exceeding 4MB).

    Submission Requirement

    • The Participant is required to “Like, Share and/or “Follow” Company Facebook or Instagram (depending on preferred platform).
    • Upon the submission of the photograph to Microsite (https://www.simedarbyproperty.com/capture8photocontest) the Participant is required to share submitted photograph to his/her Facebook and/or Instagram personal account.
    • The Participant’s Facebook and/or Instagram profile must be set in public setting.
    • Each Entry must tag @SimeDarbyProperty, add in location of the township and hashtag #SimeDarbyProperty #Capture8photocontest #<participatingtownship> (I.e. Bandar Ainsdale, KLGCC, City of Elmina etc.) #<theme> (i.e. Leisure, Nature, Culture)
    • The Participant will be contacted by Company’s representative for personal verification thereafter.
      Note: During the Campaign period, engagement on Facebook and Instagram “Like, Share, Follow and comments” are not taken into consideration for scoring.

    Special Category (Facebook and Instagram contest)

    • The Participant is required to “Like, Share and/or “Follow” the Company’s Facebook or Instagram account (depending on preferred platform)

    • Upon publishing the photograph(s), each Entry must tag @SimeDarbyProperty, add in location of the township and hashtag #SimeDarbyProperty #Capture8photocontest #<participatingtownship> (I.e., Bandar Ainsdale, KLGCC, City of Elmina etc.) #<theme> (i.e. Leisure, Nature, Culture)

    • The Participant’s Facebook and/or Instagram profile must be set as in public setting

    • The Participant will be contacted by Company’s representative for personal verification thereafter.

  • The Participant must also provide the original hi-resolution file to the Company upon request. The said file can be in the following formats which must be un-edited and edited (JPEG, JPG, TIFF, RAW, PNG). Should the Participant fails to furnish the Company with the requested photograph(s)/files, the Participant shall be automatically disqualified as the winner (if selected by the Company) and the Company shall be permitted to select another winner as a replacement at its own discretion and as it deems necessary

  • Submissions of the Entry will be evaluated by the Company based the following theme:

    1. a. Leisure – Essence of what makes the place the ultimate peace of relaxation;

    2. b. Nature / sustainability – Breathtaking beauty of nature and flourishing biodiversity there; or

    3. c. Culture - Vibrant way of life that makes the community perfect for growing families.

  • Digital and traditional photography are permitted.

  • The Participant that chooses to take photograph(s) at residential areas within the residential areas covered in the Campaign shall comply with all rules and regulations imposed by the respective residential areas including but not limited to seeking prior approval from the respective township management or residents’ associations (as may be applicable). The Participants shall be responsible for his/her own safety and security related issues arose during the visits to these developments. The Participant hereby consent and agrees that the Company, its Related Corporation, and its respective officers shall not be held liable and/or responsible in any manner whatsoever, including but not limited to any losses, destruction of and/or damage to the participant’s property, personal injury and/or death that the Participant may sustain and/or suffered due to the Participant’s visit to the residential areas for the purpose of the Campaign.

  • Incorrect or incomplete entries will be disqualified

  • Minimum touchup is acceptable

  • Superimpose and/or heavy Digital Imaging (DI) are not allowed and will be disqualified

  • Entries submitted video or Gif to any category will be disqualified

  • Entries submitted other file formats stated in Paragraph C.3 will be disqualified

  • Entry submitted before or after the period stated in Paragraph B.2 above will be disqualified

  • The winners for any wave of the Campaign are not eligible to participate in any other Campaign’s subsequent wave category.

  • The Participant is allowed to submit the same Entry for different Main Categories (Professional, Smartphone and Drone) and theme (i.e. Leisure, Nature and Culture). Similarly, the same entry in any of Main Category can also be submitted for Special Category.

  • Copyright: The Company recognizes that the Participant, as the author of the photograph(s) submitted, retain full ownership of the copyright in each entry. The Participant understand, undertakes and agrees that any photograph(s) submitted for the Campaign may be used by Company for its marketing, promotional activity or any other purposes as deem fit by Company. By participating in this Campaign, the Participant hereby grant the Company a perpetual non-exclusive royalty free license and right to use of the submitted photograph(s) in this Campaign, regardless of whether the Participant is the winner of the Campaign or not.

  • The photograph(s) that are used will be credited to the Participant as the owner of the photograph(s) and the Participant shall be deemed to have agreed to grant the Company with the perpetual non-exclusive royalty free license the photograph to the Company and its Related Corporation for the Company’s sales and marketing purpose.

  • All entries are non-returnable and the Company shall be permitted to reproduce, exhibit, publish or otherwise reuse the photograph(s) submitted in the Campaign without giving the Participant prior notification or getting the Participant’s prior consent or approval.

  • The Participant undertakes that the Participant owns the submitted photograph(s) and the whole copyright in the work vested in the photograph(s). In this respect, the Participant further undertakes that the submitted photograph(s) shall not infringe or violate any copyright, trademarks, contract’s right, passing off or any other intellectual property rights of any third party or entity or violate any other person’s rights of privacy or publicity or any applicable law. The Company shall not be held responsible in any way whatsoever for infringement or violation of any copyright, trademarks, contract’s right, passing off or any other intellectual property rights of any third party on the submitted photograph(s).

  • The photograph(s) that the Company are deemed to be offensive, threatening, false, misleading, abusive, harassing, libelous, defamatory, vulgar, obscene, scandalous, inflammatory, pornographic, or profane content, inappropriate and irrelevant or have any reference or association to sensitive matters according to any law will be disqualified from this Campaign

  • Commercial and advertising photograph(s), heavy digitally manipulated or post-processed, HDR (High Dynamic Range) or digitally montaged images are not permissible to be used in this Campaign (e.g., heavy vignette, extreme darkening of skies, toning, filter effects). In-camera multiple exposures are allowed to be used in this Campaign.

  • In all categories, minimal digital enhancement is advised but not required, subject to basic darkroom techniques for example levels, curves, dodging, burning, minimal sharpening, colour correction. The photograph(s) can be in black and white or colour. The photograph(s) must not have any borders, keyline or film edges, name, personal logos, or watermarks. Scanned film images must be free of dust marks and borders.

D. Judging of Entries

Professional, Drone and Smartphone Category

  1. The Panel of Judges for the Campaign may comprise of members of the relevant departments of Company and the professional photographer(s) as deem relevant by Company at its sole discretion (“Panel Judges”).

  2. Winners of the Campaign will be selected based on the following:

    • Twenty percent (20%) of the number of votes attained during the voting period in Microsite; and
    • Eighty percent (80%) inputs from the Panel Judges.
  3. Judging criteria for contest to the Campaign may include but not limited to the following:

    • Visual
    • Adherence/Appropriateness to Theme
    • Creativity
    • Inspirational power
    • Uniqueness of Concept
    • Originality of the Moment
    • Clarity of Expression; and/or
    • Entertainment Quality

Special Category

Winners of the Campaign will be announced on monthly basis and be selected based on the highest Like and Share on Facebook and/or Instagram throughout the Campaign Period.

Grand Finale Category

  1. The Panel Judges for the Campaign may comprise of members of the relevant departments of the Company and the professional photographers as deem relevant by Company at its sole discretion and will go through another round of judging from the first winners from each category from individual waves to select the final grand winner.

  2. The Grand Finale Category Winner of the Campaign will be selected based on:

    • (100%) inputs from the Panel Judges
  3. Judging criteria for contest may include but not limited to the following:

    • Visual
    • Adherence/Appropriateness to Theme
    • Creativity
    • Inspirational power
    • Uniqueness of Concept
    • Originality of the Moment
    • Clarity of Expression; and/or
    • Entertainment Quality

E. Prizes

There will be a total of eight (8) winners for Professional, eight (8) winners for Drone, (8) winners for Smartphone categories and eight (8) winners for Special Category who will each receive a prize (“Prizes”). The top three (3) winners chosen by the Panel Judges based on the above theme criteria stated in Paragraph C.4 each receive one (1) of the following prize packages:

  1. First place prize

Grand Prizes Category

A Trip to Battersea, London for 2 persons that includes:

  1. Economy Flight ticket (Direct Flight from Kuala Lumpur to London)
  2. Accommodation (7 days)
  3. Allowance of £500 for each

F. Claiming Prize

The Company will notify the winners via email tentatively on or one week before. The Company will also be announcing the winners publicly on Microsite on following week after the winners confirm their acceptance of the prizes. The winners are required to verify their eligibility and sign a release & waiver of liability letter (‘Letter”) to be issued by the Company. The winners agree that they only have forty-eight (48) hours upon receiving the Company’s notification of their winning (“Prescribed Period”) to (i) confirm their acceptance of the prize and (ii) verify their eligibility and return the signed Letter to Company (‘Required Response’)

The winners also agree that failure to respond to Company with the Required Respond within Prescribed Period may result in disqualification and the Company shall be entitled to select replacement winners at its sole discretion. If the replacement winners are found to be ineligible or is not in compliance with the Terms and Conditions or decline to accept the prize, or does not comply with the submission requirement, the Participant agree that prize may be forfeited by the Company at its sole discretion. The Participant further agrees that the Company shall not be held responsible for any delays in awarding the prize for any reason whatsoever.

G. Announcement of Result and Delivery of Prizes

  1. Notwithstanding paragraph F above, the results may be announced on any date as decided by the Company.

  2. Winners will be contacted by the representative of Company via e-mail, mobile number, or other reachable mediums, if needed, to verify the details and be informed of the results. Participant is also required to do the verification and provide supporting document as listed on paragraph C.3

  3. The winners agree that the prizes are not exchangeable for cash or items in kind and are not transferrable. The Company reserves the right at its sole discretion to change the prize(s) to other prize(s) or a cash prize of similar or lesser value without any prior notice is given to the winners. The prizes are subject to any other terms and conditions as may be imposed by Company from time to time.

H. Liability and Responsibility

  1. Before submitting the entry, the Participant is responsible for taking all steps necessary to protect the publicity right and other rights of persons depicted in the Entry, including but not limited to obtaining their approval, permission, consent to participate in the Campaign to avoid any cases related to the infringement of these rights.

  2. Upon the Company, as request, the Participant must be prepared to provide a signed release of liability form from all persons who appear in the photograph(s) submitted in the Campaign and/or from the owner of any material that appears in the submission, authorizing the Company and its Related Corporation to reproduce, distribute, display, and create derivative works of the entry connection with the Campaign and promotion of the Campaign, in any media now or in the future. Failure to provide such releases upon request may result in disqualification at any time during the Campaign Period and selection of winners.

  3. The Participant is responsible for the resolution of any legal issues arising from the submitted photograph(s) and agree to pay the Company any costs thereby incurred.

  4. The Participant will not be notified of the receipt of their Entry. The Participant agrees that the Company will not respond to his/her inquiries concerning their receipt of acknowledgment of his/her Entry

  5. The Participant agrees that the Company nor its Related Corporation shall not be liable for any defects (physical or operational) to the prizes nor to the merchantable quality of the same. The Company gives no representation or warranty with respect to the condition of the prizes, which shall be given on “as is basis”. The Company shall further hold no responsibility to replace any prize that is lost, stolen or defective (whether due to physical or operational defects, under warranty or otherwise). The Participant agrees to deal directly with the manufacturer or developer of the prizes for any matters/issues concerning any applicable warranty of the prizes.

  6. Unless expressly specified otherwise by Company, the prizes will be provided as a “stand-alone” product and shall not include any miscellaneous accessories or services made available in the market for such prizes regardless of any of the aforesaid accessories are displayed in any promotional materials of the Campaign which shall include but not limited to cards, posters or leaflets the illustration of which is meant for illustrative purposes only. All charges, costs and expenses (which shall include but not limited to postal charges), which may be incurred in connection to the delivery of the prizes shall be solely borne by the winners.

  7. The Participant shall not be entitled to claim for any compensation from the Company nor its Related Corporation and/or for any loss and damage suffered or incurred by the Participant due to any amendments, alterations or modifications to this Terms and Conditions and cancellation, termination, or suspension of the Campaign. The Participant agrees that the Company shall not be liable for any representations, injuries, loss or damages incurred directly or indirectly by the Participant due to the former’s participation in the Campaign and/or action or omission of the Company.

I. Personal Data Protection

  1. This Campaign is associated with Canon and Canon Printer Malaysia; however, all participants’ information will only be submitted to Company.

  2. Without limiting to the processing of the Participant’s personal data for the purpose stated in the Company’s privacy notice published at the Company website and/or at (https://www.simedarbyproperty.com/terms-of-use-and-privacy-policy/) (“Privacy Notice”), the agrees that the Participant’s personal data may be used by or on behalf of the Company for the purpose of sending to the Participant the details, including its events, academic programmes and marketing information or to provide the Participant with related information about relevant products or services. The Participant’s personal data may be held on the Company’s mailing list or database for the aforementioned purpose, unless the Participant objects to the same by notifying Company in writing.

  3. By participating in this Campaign, the Participant confirms having read, understood and agrees to the Privacy Notice for the Company to provide services or to correspond with the Participant and to improve its products and services.

J. Decision

  1. The Participant agrees that the Company’s decisions on all matters relating to the Campaign (shall be final, binding, and conclusive on the Participant and the winners. No discussion, correspondence, enquiry, appeal, or challenge in respect of any decision of the Company shall be entertained in any way whatsoever.

  2. The Participant hereby irrevocably waive all rights to make any oral or written complaints, public announcements, or statements on the Campaign, unless with prior written consent of the Company.

K. Termination, Discontinuation and Suspension

  1. The Company may at any time without prior notice terminate, discontinue, or suspend the Campaign at Company sole and absolute discretion in which case, Company may elect not to award any of the participants and such termination, discontinuation or suspension shall not give rise to any claim by the Participant.

  2. If the Company resumes the Campaign, the Participant shall abide by the decision regarding the resumption of the Campaign and the disposition of the Campaign.

L. Indemnity

  1. The Participant shall indemnify Company against any actions, suits proceedings, claims, demands, fines, penalties, costs, and expenses (including but not limited to legal costs on solicitor and client basis) which may be brought or made against or incurred by Company in any way whatsoever.

M. General Terms and Conditions

  1. The laws of Malaysia shall be the governing law of these Terms and Conditions of the Campaign.

  2. The Company may in its discretion refuse to award any prize to any participant who fails to comply with any of these Terms and Conditions. All relevant instructions on the Microsite constitutes part of the Terms and Conditions hereof.

  3. The Company reserves the right to request the winner to provide proof of his/her age, identity and/or residency in order to claim the prize and if the winner is unable to provide the Company with such proof, the winner agrees that the Company shall be entitled to forfeit the prize in whole and no substitution prize will be offered by the Company to the winner.

  4. The Participant hereby irrevocably and unconditionally consent to:-

    1. a. if so required by the Company, make himself/herself available (without compensation) for the production, recording and publicity of the Campaign at such dates, times and venues as may be notified by Company from time to time including but not limited for the following purpose:-
      • i. interview (which may be recorded); and/or
      • ii. taking of still photograph(s), audio and/or visual recording for promotions and publicity use.
    2. b. give the sole and absolute discretion to Company to publish, print and/or broadcast the items in this paragraph M.4(a).
